Article 19

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

After the assessment of the receivable under its special law, the difference between the precautionary assessment and the assessment based on its special law shall be corrected in accordance with the assessment based on the special law.

For this correction to be made, in assessments based on a return, the return submitted must have been examined and accepted; in assessments subject to objection, finality must have been attained; and in cases where an application has been made to the Council of State, a final decision must have been rendered by the Council of State.

The return for the period that is the subject of the precautionary assessment must be examined within two months at the latest from the date of its submission. If the examination is not carried out within this period, the correction shall not be delayed for this reason.

MADDE 19

Alacağın hususi kanununa göre tahakkukundan sonra, ihtiyati tahakkukla hususi kanununa müstenit tahakkuk arasındaki fark, hususi kanununa müstenit tahakkuka göre düzeltilir.

Bu düzeltmenin yapılabilmesi için beyannameye müstenit tarhiyatta verilen beyannamenin tetkik edilerek kabul edilmiş olması, itirazlı tarhiyatta kesinleşmenin vukuu, Devlet Şûrasına müracaat edilmiş olan hallerde Devlet Şûrasından nihai bir kararın çıkmış olması lazımdır.

İhtiyati tahakkuk mevzuu olan devre beyannamesinin, verildiği tarihten itibaren en geç iki ay içinde tetkikı mecburidir. Bu müddet içinde tetkik yapılmadığı takdirde, bu sebeple düzeltme geciktirilmez.
