Article 29

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

Of the dispositions made, within the two years preceding the date on which the payment period began or after the commencement of the payment period, by those debtors who do not pay the public receivable and who have failed to make a declaration of assets within the time limit or despite coercive imprisonment, or who have declared that they have no property, or whose declared property is found to be insufficient to cover their debt, the following shall be null and void:

1. Pledges made by the debtor to secure an existing debt, except where the debtor had previously undertaken to provide security,

2. Payments made against a debt otherwise than in cash or by customary means of payment,

3. Payments made for a debt not yet due.

MADDE 29

Amme alacağını ödemiyen borçlulardan müddetinde veya hapsen tazyikına rağmen mal beyanında bulunmıyanlarla, malı bulunmadığını bildiren veyahut beyan ettiği malların borcuna kifayetsizliği anlaşılanların ödeme müddetinin başladığı tarihten geriye doğru iki yıl içinde veya ödeme müddetinin başlamasından sonra yaptıkları tasarruflardan aşağıda belirtilenler hükümsüzdür:

1. Borçlunun teminat göstermeyi evvelce taahhüt etmiş olduğu haller müstesna olmak üzere borçlu tarafından mevcut bir borcu temin için yapılan rehinler,

2. Borca karşılık para veya mütat ödeme vasıtalarından gayrı bir suretle yapılan ödemeler,

3. Vadesi gelmemiş bir borç için yapılan ödemeler.

Amme alacağının tahsiline imkan bırakmamak maksadiyle yapılan tasarruflar:
