Payment shall be made against a receipt to be issued by the authorised and responsible officers of the creditor collection office.
Added paragraph: 25/12/2003, Law No. 5035, Art. 3 The Ministry of Finance is authorised to make it compulsory for payment to be made by using special forms of payment. This authority may be exercised collectively or separately with respect to collection offices, the type of public receivable, the time of payment and the stages at which it stands.
Payments not made against a receipt and payments made to persons other than the authorised and responsible officers may not be set off against the public receivable.
The form of the receipts used in the collection of public receivables shall be determined by the relevant public administrations.
Debtors are obliged to keep their receipts until the end of the limitation period for the collection of the public receivable and to present them when requested by authorised officers.
In cases where the receipt must be sent to the debtor by post, the postage cost shall be borne by the creditor public administration.
The provisions of special laws concerning collections made in forms other than the issuance of a receipt are reserved.

MADDE 40
Ödeme, alacaklı tahsil dairesinin salahiyetli ve mesul memurları tarafından verilecek makbuz karşılığı yapılır.
(Ek fıkra: 25/12/2003-5035/3 md.) Maliye Bakanlığı, ödemenin özel ödeme şekilleri kullanılmak suretiyle yapılması zorunluluğunu getirmeye yetkilidir. Bu yetki; tahsil daireleri, amme alacağının türü, ödeme zamanı ve bulunduğu safhalar itibarıyla topluca veya ayrı ayrı kullanılabilir.
Makbuz karşılığı yapılmıyan ödemelerle salahiyetli ve mesul memurlardan başkalarına yapılan ödemeler amme alacağına mahsup edilemez.
Amme alacaklarının tahsilinde kullanılan makbuzların şeklini ilgili amme idareleri tayin eder.
Borçlular makbuzlarını amme alacağının tahsil zamanaşımı müddeti sonuna kadar saklamaya ve salahiyetli memurlarca istendiğinde göstermeye mecburdurlar.
Makbuzun borçluya posta ile gönderilmesi gerektiği hallerde posta masrafı alacaklı amme idaresine aittir.
Hususi kanunlarındaki makbuz verilmesinden başka şekillerde yapılan tahsilata ait hükümler mahfuzdur.
