Article 42

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

Payments made by crossed cheque are subject to the provisions of the Commercial Code; however:

1. A cheque issued for the payment of a public receivable shall be drawn in the name of the relevant tax office, with the annotation that it is not to order, and on a bank. The Ministry of Finance is authorised to determine the information to be entered on the cheque for the purpose of identifying the receivable, provided that it is not contrary to the Commercial Code.

2. Where a cheque or transfer order, or a payment made by bank card, credit card and similar cards, is not honoured for any reason, the public creditor's right of recourse against the debtor is reserved.

Where action is taken pursuant to paragraph 2, the non-acceptance of the cheque or transfer order shall be documented and this situation shall be notified to the person requesting the transfer, the drawer or their representatives, and the unaccepted cheque shall be returned.

MADDE 42

Çizgili çekle yapılan ödemeler Ticaret Kanunu hükümlerine tabidir, ancak:

1. Amme alacağının ödenmesi için düzenlenen çek ilgili vergi dairesi adına, emre muharrer olmadığı kaydı ile ve bir banka üzerine çekilir. Alacağın teşhisine yaramak ve Ticaret Kanununa aykırı olmamak üzere çek üzerine dercedilecek malümatı tesbit etmeye Maliye Vekaleti salahiyetlidir.

2. Çek veya münakale emrinin veya banka kartı, kredi kartı ve benzeri kartlar ile yapılan ödemenin herhangi bir sebeple tediye edilmemesi halinde amme alacaklısının borçluya karşı rücu hakkı mahfuzdur.

2 numaralı fıkra gereğince muamele yapıldığı takdirde çek veya münakale emrinin kabul edilmemesi keyfiyeti tevsik ve bu durum münakale istiyene, keşideciye veya bunların temsilcilerine tebliğ edilerek kabul edilmiyen çek iade olunur.
