Article 50

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

Proceedings against a debtor whose wife or husband, or one of whose ascendants or descendants by blood or by marriage, has died shall be postponed for three days including the day of death.

In the event of the death of the debtor, proceedings for the debts of the estate shall be postponed for three days including the day of death. Upon the expiry of the three days, proceedings shall be continued for the debts of the estate.

Where the heirs have not accepted or renounced the inheritance, proceedings shall be postponed until the expiry of the specific periods laid down in the Civil Code in this respect.

Karısı yahut kocası, kan ve sıhriyet itibariyle usul veya furuundan birisi ölen borçlu hakkındaki takip ölüm günü ile beraber üç gün için geri bırakılır.

Borçlunun ölümü halinde terekenin borçlarından dolayı ölüm günü ile beraber üç gün için takip geri bırakılır. Üç günün bitiminde terekenin borçları için takibata devam olunur.

Mirasçılar, mirası kabul veya ret etmemişlerse bu hususta Medeni Kanundaki muayyen müddetler geçinceye kadar takip geri bırakılır.
