Article 58

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

A person to whom a payment order has been served may, within 15 days from the date of service, file an objection with the tax objection commission dealing with objection matters of the creditor collection office, on the ground that he or she has no such debt, or has partly paid it, or that it is time-barred by limitation. The provisions of the Tax Procedure Law shall apply as regards the form of the objection, its examination and the return of objection examinations.

A debtor objecting to part of the debt must clearly indicate the grounds and amount of that part; otherwise, the objection shall be deemed not to have been made.

The objection commission is obliged to decide on these objections within 7 days at the latest.

The decisions of the objection commissions on this matter are final.

Where objections made under this Article against the whole of the debt are rejected wholly or partly, the debtor is obliged to make a declaration of assets within 15 days from the date of service on him or her of the rejection decision.

Objections made under this Article against part of the debt may not extend the period for making a declaration of assets.

MADDE 58

Kendisine ödeme emri tebliğ olunan şahıs, böyle bir borcu olmadığı veya kısmen ödediği veya zamanaşımına uğradığı hakkında tebliğ tarihinden itibaren 15 gün içinde alacaklı tahsil dairesine ait itiraz işlerine bakan vergi itiraz komisyonu nezdinde itirazda bulunabilir. İtirazın şekli, incelenmesi ve itiraz incelemelerinin iadesi hususlarında Vergi Usul Kanunu hükümleri tatbik olunur.

Borcun bir kısmına itiraz eden borçlunun o kısmın cihet ve miktarını açıkça göstermesi lazımdır, aksi halde itiraz edilmemiş sayılır.

İtiraz komisyonu bu itirazları en geç 7 gün içinde karara bağlamak mecburiyetindedir.

Borcun tamamına bu madde gereğince vakı itirazların tamamen veya kısmen reddi halinde, borçlu ret kararının kendisine tebliği tarihinden itibaren 15 gün içinde mal bildiriminde bulunmak mecburiyetindedir.

Borcun bir kısmına karşı bu madde gereğince vakı itirazlar mal bildiriminde bulunma müddetini uzatamaz.
