Article 59

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

A declaration of assets is the notification by the debtor to the collection office, in writing or orally, of the type, nature, characteristics and value of such of the assets, receivables and rights held by the debtor or in the hands of third persons as are sufficient to cover the debt, and all kinds of income, or that there are no attachable assets or income, and of the sources of livelihood according to the debtor's way of life and, in view thereof, how the debtor can pay the debt.

Amended: 26/11/1980, Law No. 2347, Art. 6 In villages, the declaration of assets may also be made to the village headman's office for public debts other than taxes to be determined and announced by the Ministry of Finance.

In the case of oral declaration, the matter shall be recorded in a report. In both cases, the public debtor shall be given a receipt free of stamp duty stating that the declaration has been made.

MADDE 59

Mal bildirimi, borçlunun gerek kendisinde, gerekse üçüncü şahıslar elinde bulunan mal, alacak ve haklarından borcuna yetecek miktarın, nevini, mahiyetini, vasfını, değerini ve her türlü gelirlerini veya haczi kabil mal veya geliri bulunmadığını ve yaşayış tarzına göre geçim kaynaklarını ve buna nazaran borcunu ne suretle ödiyebileceğini yazı ile veya sözle tahsil dairesine bildirmesidir.

(Değişik: 26/11/1980 - 2347/6 md.) Köylerde mal bildirimi, Maliye Bakanlığınca tespit ve ilan edilecek vergiler dışında kalan amme borçları için köy muhtarlığına da yapılabilir.

Sözle bildirim halinde kayfiyet bir zabıtla tesbit edilir. Her iki halde bildirimin yapıldığına dair amme borçlusuna pulsuz makbuz verilir.
