Article 8

CHAPTER ONE: Tax Liability

Amended: 8/1/2002, Law No. 4736, Art. 4 The rate of building tax shall be one per thousand for residences and two per thousand for other buildings. These rates shall be applied increased by 100% within the boundaries of metropolitan municipalities to which Law No. 5216 applies and within contiguous areas. The President of the Republic is authorised to reduce the tax rates down to one half or to increase them up to three times.

Amended paragraph 2: 30/7/2003, Law No. 4962, Art. 15 The President of the Republic is authorised to reduce to zero the tax rates applicable to the residences of persons who document that they have no income whatsoever (excluding persons under eighteen years of age who have someone obliged to support them), persons whose income consists exclusively of pensions received from social security institutions established by law, veterans, persons with disabilities, and widows and orphans of martyrs, where they have a single residence within the borders of Türkiye not exceeding 200 m² gross (including where they hold a right of usufruct over it). This provision shall also apply to the portion corresponding to their shares where the above-mentioned persons own a single residence by way of a share. This provision shall not apply to residences used for recreation at certain times. The Ministry of Finance is authorised to determine the procedures and principles for documenting the absence of income.

The tax on a newly constructed building or buildings may not be less than the tax on its land (or land share). Added sentence: 30/7/2003, Law No. 4962, Art. 15 This provision shall apply for four years starting from the budget year following the year in which the construction of the buildings is completed.

(Değişik: 8/1/2002-4736/4 md.) Bina vergisinin oranı meskenlerde binde bir, diğer binalarda ise binde ikidir. Bu oranlar, 5216 sayılı Kanunun uygulandığı büyük şehir belediye sınırları ve mücavir alanlar içinde % 100 artırımlı uygulanır. Cumhurbaşkanı, vergi oranlarını yarısına kadar indirmeye veya üç katına kadar artırmaya yetkilidir.

Cumhurbaşkanı, kendisine bakmakla mükellef kimsesi olup onsekiz yaşını doldurmamış olanlar hariç olmak üzere hiçbir geliri olmadığını belgeleyenlerin, gelirleri münhasıran kanunla kurulan sosyal güvenlik kurumlarından aldıkları aylıktan ibaret bulunanların, gazilerin, engellilerin, şehitlerin dul ve yetimlerinin Türkiye sınırları içinde brüt 200 m²’yi geçmeyen tek meskeni olması (intifa hakkına sahip olunması hali dahil) halinde, bu meskenlerine ait vergi oranlarını sıfıra kadar indirmeye yetkilidir. Bu hüküm, yukarıda belirtilenlerin tek meskene hisse ile sahip olmaları halinde hisselerine ait kısım hakkında da uygulanır. Muayyen zamanda dinlenme amacıyla kullanılan meskenler hakkında bu hüküm uygulanmaz. Geliri olmadığını belgelemenin usul ve esaslarını belirlemeye Maliye Bakanlığı yetkilidir.

Yeni inşa edilen bina veya binaların vergisi, arsasının (veya arsa payının) vergisinden az olamaz. (Ek cümle: 30/7/2003-4962/15 md.) Bu hüküm binaların inşalarının sona erdiği yılı takip eden bütçe yılından itibaren dört yıl uygulanır.
