If the ground for divorce is proven, the judge shall decide on divorce or separation.
If the action relates only to separation, divorce may not be decided.
If the action relates to divorce, separation may be decided only where there is a possibility of re-establishing common life.

MADDE 170 · I. Boşanma veya ayrılık
Boşanma sebebi ispatlanmış olursa, hâkim boşanmaya veya ayrılığa karar verir.
Dava yalnız ayrılığa ilişkinse, boşanmaya karar verilemez.
Dava boşanmaya ilişkinse, ancak ortak hayatın yeniden kurulması olasılığı bulunduğu takdirde ayrılığa karar verilebilir.
