Article 190: III. Revocation or restriction of the power of representation

Book Two: FAMILY LAW › Part One: LAW OF MARRIAGE › Chapter Three: GENERAL EFFECTS OF MARRIAGE A. Rights and obligations

If one of the spouses exceeds the power to represent the union or proves incapable of exercising this power, the judge may, upon the request of the other spouse, revoke or restrict the power of representation. The requesting spouse may notify third parties of the revocation or restriction of the power of representation only by personal notice.

The revocation or restriction of the power of representation shall have effect against third parties in good faith only if it is publicly announced by decision of the judge.

MADDE 190 · III. Temsil yetkisinin kaldırılması veya sınırlanması

Eşlerden biri birliği temsil yetkisini aşar veya bu yetkiyi kullanmada yetersiz kalırsa hâkim, diğer eşin istemi üzerine temsil yetkisini kaldırabilir veya sınırlayabilir. İstemde bulunan eş, temsil yetkisinin kaldırıldığını veya sınırlandığını, üçüncü kişilere sadece kişisel duyuru yoluyla bildirebilir.

Temsil yetkisinin kaldırılmasının veya sınırlanmasının iyiniyetli üçüncü kişilere karşı sonuç doğurması, durumun hâkimin kararıyla ilân edilmesine bağlıdır.
