Article 217: H. Debts between spouses

The marital property regime does not prevent debts between the spouses from becoming due. Nevertheless, where the performance of a debt would cause the debtor spouse serious difficulties to a degree that would endanger the marital union, that spouse may request time for payment. Where the circumstances so require, the judge shall oblige the requesting spouse to provide security.

MADDE 217 · H. Eşler arasındaki borçlar

Mal rejimi, eşler arasındaki borçların muaccel olmasını önlemez. Bununla beraber bir borcun yerine getirilmesi, borçlu eşi evlilik birliğini tehlikeye düşürecek derecede önemli güçlüklere sokacaksa, bu eş ödeme için süre isteyebilir. Durum ve koşullar gerektiriyorsa, hâkim istemde bulunan eşi güvence göstermekle yükümlü tutar.
