Article 468: C. Liability of the State

Book Two: FAMILY LAW › Part Three: GUARDIANSHIP › Chapter Two: CONDUCT OF GUARDIANSHIP › Division Four: LIABILITY OF THE GUARDIANSHIP ORGANS

The State shall be directly liable for damage unlawfully caused by persons serving in the guardianship bodies, and shall also be liable for damage that cannot be recovered from guardians, curators and legal advisers.

The State that has compensated the damage shall have recourse against those at fault in the occurrence of the damage.

Those who have caused the damage through their fault shall be jointly and severally liable to the State exercising its right of recourse.

MADDE 468 · C. Devletin sorumluluğu

Devlet, vesayet dairelerinde görevli olanların hukuka aykırı olarak sebebiyet verdikleri zararlardan doğrudan doğruya sorumlu olduğu gibi; vasi, kayyım ve yasal danışmanlara tazmin ettirilemeyen zararlardan da sorumludur.

Zararı tazmin eden Devlet, zararın meydana gelmesinde kusurlu olanlara rücu eder.

Zararın doğmasına kusurları ile sebep olanlar, rücu hakkını kullanan Devlete karşı müteselsilen sorumludurlar.
