Article 586: II. Inheritance falling to an absent person

Book Three: LAW OF SUCCESSION › Part Two: DEVOLUTION OF THE ESTATE › Chapter One: OPENING OF THE SUCCESSION

The share of the estate of an heir who is missing and in respect of whom it cannot be proven whether he was alive at the moment of opening of the succession shall be administered officially.

Those to whom the share of the missing person would pass if he was not alive at the moment of opening of the succession may, in compliance with the time limits and procedure relating to absence, request that the person be declared absent and that his share be delivered to them.

The delivery of the share of the estate shall be subject to the rules on the delivery of the estate of a person declared absent to the heirs.

MADDE 586 · II. Gaibe düşen miras

Ortada bulunmayan ve mirasın açıldığı anda sağ olup olmadığı ispat edilemeyen mirasçının miras payı resmen yönetilir.

Mirasın açıldığı anda ortada bulunmayanın sağ olmaması hâlinde onun miras payı kendilerine kalacak olanlar, gaipliğe ilişkin sürelere ve usule uyarak o kimsenin gaipliğine karar verilmesini ve miras payının kendilerine teslimini isteyebilirler.

Miras payının teslimi, gaipliğine karar verilen kimsenin mirasının mirasçılara teslimine ilişkin kurallara tâbidir.
