Article 594: III. Unknown heirs

Book Three: LAW OF SUCCESSION › Part Two: DEVOLUTION OF THE ESTATE › Chapter Two: EFFECTS OF THE DEVOLUTION OF THE ESTATE › Division One: PROTECTIVE MEASURES

If it is not known whether the deceased has any heirs, or if not all of the heirs are known, the judge of the civil court of peace shall publish two notices by appropriate means at an interval of one month and call upon the persons entitled to declare their status as heirs within one year at the latest from the last notice.

If no one applies within the notice period and the judge of the civil court of peace has been unable to identify any heir, the estate shall pass to the State, without prejudice to the right to bring an action for recovery of the inheritance.

MADDE 594 · III. Mirasçıların bilinmemesi

Mirasbırakanın mirasçısı bulunup bulunmadığı veya mirasçıların tamamı bilinmiyorsa, sulh hâkimi uygun araçlarla ve bir ay ara ile iki defa ilân yapıp hak sahiplerini son ilândan başlayarak en geç bir yıl içinde mirasçılık sıfatlarını bildirmeye çağırır.

İlân süresinde kimse başvurmazsa ve sulh hâkimi de hiçbir mirasçı tespit edememişse, miras sebebiyle istihkak davası açma hakkı saklı kalmak üzere miras Devlete geçer.
