Article 600: 1. Claim

Book Three: LAW OF SUCCESSION › Part Two: DEVOLUTION OF THE ESTATE › Chapter Two: EFFECTS OF THE DEVOLUTION OF THE ESTATE › Division Two: ACQUISITION OF THE ESTATE A. Acquisition

The legatee shall have a personal claim against the executor, if there is one; otherwise, against the statutory or appointed heirs.

Unless otherwise apparent from the disposition, this claim becomes due upon the acceptance of the estate by the person charged with the legacy or upon the lapse of his right to disclaim.

The legatee may bring an action against a person charged with the legacy who fails to perform his obligation, for the delivery of the bequeathed property or the transfer of the right or, where the subject of the legacy is an act, for compensation for the damage arising from its non-performance.

MADDE 600 · 1. İstem

Vasiyet alacaklısı, vasiyeti yerine getirme görevlisi varsa ona; yoksa yasal veya atanmış mirasçılara karşı kişisel bir istem hakkına sahip olur.

Bu alacak, tasarruftan aksi anlaşılmıyorsa vasiyet yükümlüsünün mirası kabul etmesi veya ret hakkının düşmesiyle muaccel olur.

Vasiyet alacaklısı, yükümlülüğünü yerine getirmeyen vasiyet yükümlüsüne karşı, vasiyet edilen malın teslimini veya hakkın devrini; vasiyet konusu bir davranış ise, bunun yerine getirilmemesinden doğan zararın giderilmesini dava edebilir.
