Where a co-owner establishes a usufruct over his own share and one of the other co-owners requests partition within three months from the notification to him of the establishment of the usufruct, then in the case of partition by sale the usufruct shall continue over the proceeds attributable to the share concerned.

MADDE 700 · c. İntifa hakkı sahibinin durumu
Bir paydaşın kendi payı üzerinde intifa hakkı kurması hâlinde, diğer paydaşlardan biri intifa hakkının kurulduğunun kendisine tebliğinden başlayarak üç ay içinde paylaşma isteminde bulunursa; satış yoluyla paylaşmada intifa hakkı, buna ilişkin paya düşecek bedel üzerinde devam eder.
