Article 13: Special jurisdiction

Part One: Scope, Definitions, Subject-Matter Jurisdiction and Territorial Jurisdiction › Chapter Four: Territorial jurisdiction

(1) If the place where the offence was committed is not known, the court of the place where the suspect or the accused was apprehended or, if he has not been apprehended, the court of his domicile shall have jurisdiction.

(2) If the suspect or the accused has no domicile in Türkiye, the court of the place of his last address in Türkiye shall have jurisdiction.

(3) If it is not possible to determine the court in this manner either, the court of the place where the first procedural act was performed shall have jurisdiction.

MADDE 13 · Özel yetki

(1) Suçun işlendiği yer belli değilse, şüpheli veya sanığın yakalandığı yer, yakalanmamışsa yerleşim yeri mahkemesi yetkilidir.

(2) Şüpheli veya sanığın Türkiye'de yerleşim yeri yoksa Türkiye'de en son adresinin bulunduğu yer mahkemesi yetkilidir.

(3) Mahkemenin bu suretle de belirlenmesi olanağı yoksa, ilk usul işleminin yapıldığı yer mahkemesi yetkilidir.
