Article 4: Ex officio decision on jurisdiction and conflict of jurisdiction

Part One: Scope, Definitions, Subject-Matter Jurisdiction and Territorial Jurisdiction › Chapter Two: Subject-matter jurisdiction

(1) The court hearing the action may decide ex officio, at every phase of the prosecution stage, whether or not it has jurisdiction. The provision of Article 6 is reserved.

(2) Where a dispute arises between courts concerning jurisdiction, the competent court shall be determined by the common higher court.

MADDE 4 · Re'sen görev kararı ve görevde uyuşmazlık

(1) Davaya bakan mahkeme, görevli olup olmadığına kovuşturma evresinin her aşamasında re'sen karar verebilir. 6 ncı madde hükmü saklıdır.

(2) Görev konusunda mahkemeler arasında uyuşmazlık çıktığında, görevli mahkemeyi ortak yüksek görevli mahkeme belirler.
