Article 16: Jurisdiction over connected offences

Part One: Scope, Definitions, Subject-Matter Jurisdiction and Territorial Jurisdiction › Chapter Four: Territorial jurisdiction

(1) Connected criminal actions each of which falls within the jurisdiction of different courts according to the above Articles may be joined and heard before any one of the competent courts.

(2) If the hearing of connected criminal actions has commenced before different courts, all or some of these actions may be joined before one of these courts upon an agreement to be reached between the courts, provided that it conforms with the requests of the public prosecutors.

(3) If no agreement is reached, upon the request of the public prosecutor or the accused, the common higher court shall decide whether joinder is necessary and, if so, before which court the actions shall be joined.

(4) The separation of joined actions shall also take place in this manner.

MADDE 16 · Bağlantılı suçlarda yetki

(1) Yukarıdaki maddelere göre her biri değişik mahkemelerin yetkisi içinde bulunan bağlantılı ceza davaları, yetkili mahkemelerden herhangi birisinde birleştirilerek görülebilir.

(2) Bağlantılı ceza davalarının değişik mahkemelerde bakılmasına başlanmış olursa, Cumhuriyet savcılarının istemlerine uygun olmak koşuluyla, mahkemeler arasında oluşacak uyuşma üzerine, bu davaların hepsi veya bir kısmı bu mahkemelerin birinde birleştirilebilir.

(3) Uyuşulmazsa, Cumhuriyet savcısı veya sanığın istemi üzerine ortak yüksek görevli mahkeme birleştirmeye gerek olup olmadığına ve gerek varsa hangi mahkemede birleştirileceğine karar verir.

(4) Birleştirilmiş olan davaların ayrılması da bu suretle olur.
