Article 309: Violation of the Constitution

Book Two: Special Provisions › Part Four: Offences against the Nation and the State, and Final Provisions › Chapter Five: Offences against the Constitutional Order and its Functioning

(1) Persons who attempt, by use of force and violence, to abolish the order prescribed by the Constitution of the Republic of Türkiye, or to establish another order in its place, or to prevent the actual implementation of this order, shall be punished with aggravated life imprisonment.

(2) Where other offences are committed during the commission of this offence, a penalty shall additionally be imposed for those offences in accordance with the relevant provisions.

(3) Security measures specific to legal persons shall be ordered against legal persons on account of the commission of the offences defined in this Article.

MADDE 309 · Anayasayı ihlal

(1) Cebir ve şiddet kullanarak, Türkiye Cumhuriyeti Anayasasının öngördüğü düzeni ortadan kaldırmaya veya bu düzen yerine başka bir düzen getirmeye veya bu düzenin fiilen uygulanmasını önlemeye teşebbüs edenler ağırlaştırılmış müebbet hapis cezası ile cezalandırılırlar.

(2) Bu suçun işlenmesi sırasında başka suçların işlenmesi halinde, ayrıca bu suçlardan dolayı ilgili hükümlere göre cezaya hükmolunur.

(3) Bu maddede tanımlanan suçların işlenmesi dolayısıyla tüzel kişiler hakkında bunlara özgü güvenlik tedbirlerine hükmolunur.
