Article 303: Collaborating with the enemy

Book Two: Special Provisions › Part Four: Offences against the Nation and the State, and Final Provisions › Chapter Four: Offences against the Security of the State

(1) Any citizen who accepts service in the army of a state at war with the State of the Republic of Türkiye, or who engages in armed struggle against the State of the Republic of Türkiye on the side of the enemy state, shall be punished with life imprisonment.

(2) Any citizen who assumes any command duty in the army of the enemy state shall be punished with aggravated life imprisonment.

(3) Where other offences are committed during the commission of the offences defined in paragraphs 1 and 2, a penalty shall additionally be imposed for those offences in accordance with the relevant provisions.

(4) No penalty shall be imposed on this ground on a citizen who, being in the territory of the enemy state in time of war, is compelled to be taken into service in the army of that state.

MADDE 303 · Düşmanla işbirliği yapmak

(1) Türkiye Cumhuriyeti Devleti ile savaş halinde olan devletin ordusunda hizmet kabul eden, düşman devletin yanında Türkiye Cumhuriyeti Devletine karşı silahlı mücadeleye giren vatandaş, müebbet hapis cezası ile cezalandırılır.

(2) Düşman devlet ordusunda herhangi bir komuta görevi üstlenen vatandaş, ağırlaştırılmış müebbet hapis cezası ile cezalandırılır.

(3) Bir ve ikinci fıkralarda tanımlanan suçların işlenmesi sırasında başka suçların işlenmesi halinde, ayrıca bu suçlardan dolayı ilgili hükümlere göre cezaya hükmolunur.

(4) Savaş zamanında düşman devlet toprağında bulunup da bu devlet ordusunda hizmete alınmak mecburiyetinde kalan vatandaş hakkında, bu nedenle cezaya hükmolunmaz.
