Article 300: Degrading the symbols of sovereignty of the State

Book Two: Special Provisions › Part Four: Offences against the Nation and the State, and Final Provisions › Chapter Three: Offences against the Symbols of Sovereignty of the State and the Dignity of its Organs

(1) Any person who publicly degrades the Turkish Flag by tearing, burning or in any other manner shall be punished with imprisonment from one to three years. This provision shall apply to any sign bearing the characteristics of the red flag with the white crescent and star determined in the Constitution and used as a symbol of sovereignty of the State of the Republic of Türkiye.

(2) Any person who publicly degrades the National Anthem (İstiklal Marşı) shall be punished with imprisonment from six months to two years.

(3) Where the offences defined in this Article are committed by a Turkish citizen in a foreign country, the penalty to be imposed shall be increased by one third.

MADDE 300 · Devletin egemenlik alametlerini aşağılama

(1) Türk Bayrağını yırtarak, yakarak veya sair surette ve alenen aşağılayan kişi, bir yıldan üç yıla kadar hapis cezası ile cezalandırılır. Bu hüküm, Anayasada belirlenen beyaz ay yıldızlı al bayrak özelliklerini taşıyan ve Türkiye Cumhuriyeti Devletinin egemenlik alameti olarak kullanılan her türlü işaret hakkında uygulanır.

(2) İstiklal Marşını alenen aşağılayan kişi, altı aydan iki yıla kadar hapis cezası ile cezalandırılır.

(3) Bu maddede tanımlanan suçların yabancı bir ülkede bir Türk vatandaşı tarafından işlenmesi halinde, verilecek ceza üçte bir oranında artırılır.
