Article 221: Failure of a third person to submit a document

Part Four: Proof and Evidence › Chapter Two: Documents and Deeds

(1) If the court decides that a document in the possession of a third person or institution is essential for proving a matter asserted by the parties, it shall order the submission of that document.

(2) Everyone ordered to submit a document shall be obliged to submit the document in his or her possession or, if unable to submit the document, to explain the reason therefor together with the evidence. If the court does not find the explanation sufficient, it may hear that person as a witness.

(3) Those obliged to submit a document may refuse to submit the document or to testify on that matter in accordance with the provisions on refusal to testify. The provisions relating to witnesses shall apply to those who are obliged to submit a document or to testify on that matter.

MADDE 221 · Üçüncü kişinin belgeyi ibraz etmemesi

(1) Mahkeme, üçüncü kişi veya kurumun elinde bulunan bir belgenin taraflarca ileri sürülen hususun ispatı için zorunlu olduğuna karar verirse, bu belgenin ibrazını emreder.

(2) Belgeyi ibraz etmesine karar verilen herkes, elindeki belgeyi ibraz etmek; belgeyi ibraz edememesi hâlinde ise bunun sebebini delilleri ile birlikte açıklamak zorundadır. Mahkeme yapılan açıklamayı yeterli görmezse, bu kimseyi tanık olarak dinleyebilir.

(3) Belgeyi ibraz zorunda olanlar, tanıklıktan çekinmeye ilişkin hükümlere göre, belgeyi ibrazdan veya bu konudaki tanıklıktan çekinebilirler. Belgeyi ibraz veya bu konuda tanıklık yapmak zorunda olanlar hakkında, tanıklara ilişkin hükümler uygulanır.
