Article 213: Unjustified allegation of forgery

Part Four: Proof and Evidence › Chapter Two: Documents and Deeds

(1) If the party whose allegation of forgery proves unjustified is in bad faith, that party shall be ordered to pay the hearing fee for each hearing adjourned for this reason and, upon request, to compensate the damage suffered by the other party for this reason.

(2) When the signature or handwriting on an official deed is denied, the above fee amount shall be applied twofold.

(3) If the parties withdraw their allegations of forgery before an expert examination is ordered, the judge may reduce the compensation or may not award compensation.

MADDE 213 · Haksız yere sahtelik iddiası

(1) Sahtelik iddiası sonunda haksız çıkan taraf kötü niyetli ise bu sebeple ertelenen her bir duruşma için celse harcına ve talep hâlinde bu sebeple diğer tarafın uğradığı zararları tazmin etmeye mahkûm edilir.

(2) Resmî senetteki imza veya yazı inkâr edildiğinde, yukarıdaki harç miktarı iki katı olarak uygulanır.

(3) Bilirkişi incelemesi yapılmasına karar verilmesinden önce, tarafların sahteliğe ilişkin iddialarından vazgeçmeleri hâlinde, hâkim, tazminattan indirim yapabileceği gibi tazminata hükmetmeyebilir.
