Article 205: Evidential force of private deeds

Part Four: Proof and Evidence › Chapter Two: Documents and Deeds

(1) Private deeds acknowledged before the court or accepted by the court as originating from the person denying them shall be deemed conclusive evidence unless the contrary is proven.

(2) Electronic data duly created with a secure electronic signature shall have the force of a deed.

(3) The judge shall examine ex officio whether a document bearing an electronic signature submitted to the court as evidence has been created with a secure electronic signature.

MADDE 205 · Adi senetlerin ispat gücü

(1) Mahkeme huzurunda ikrar olunan veya mahkemece inkâr edenden sadır olduğu kabul edilen adi senetler, aksi ispat edilmedikçe kesin delil sayılırlar.

(2) Usulüne göre güvenli elektronik imza ile oluşturulan elektronik veriler, senet hükmündedir.

(3) Hâkim, mahkemeye delil olarak sunulan elektronik imzalı belgenin, güvenli elektronik imza ile oluşturulmuş olup olmadığını resen inceler.
