Article 273: Determination of the expert's scope of assignment

Part Four: Proof and Evidence › Chapter Five: Expert Examination

(1) In its decision on the appointment of an expert, which the court shall make after also obtaining the opinion of the parties, the court is obliged to include the following matters:

a) A clear determination of the subject of examination with all its limits.

b) The questions the expert must answer.

c) The time limit for submitting the report.

(2) The things the expert is to examine shall be delivered to the expert as an annex to the letter of appointment, attached to an inventory list and, if necessary, in sealed form; and this matter shall also be indicated in the record.

MADDE 273 · Bilirkişinin görev alanının belirlenmesi

(1) Mahkeme, tarafların da görüşünü almak suretiyle bilirkişinin görevlendirilmesine ilişkin kararında, aşağıda belirtilen hususlara yer vermek zorundadır:

a) İnceleme konusunun bütün sınırlarıyla ve açıkça belirlenmesi.

b) Bilirkişinin cevaplaması gereken sorular.

c) Raporun verilme süresi.

(2) Bilirkişiye, görevlendirme yazısının ekinde, inceleyeceği şeyler, dizi pusulasına bağlı olarak ve gerekiyorsa mühürlü bir biçimde teslim edilir; ayrıca bu husus tutanakta gösterilir.
