Article 295: Deliberation on the judgment

Part Five: Judgment and Acts of the Parties Terminating the Action › Chapter One: Judgment

(1) The judgment shall be prepared through secret deliberation and shall be pronounced publicly.

(2) The judgment shall be rendered by the judge or judges present at the hearing at which the conclusion of the proceedings was announced. Deliberation on the judgment may not take place unless all the judges who may render the judgment in this manner are present.

(3) If, during the deliberation on the judgment, a judge who was present at the hearing at which the conclusion of the proceedings was announced is not present, the deliberation shall be held and the judgment rendered after the oral statements of the parties are heard again, if deemed necessary.

MADDE 295 · Hükmün müzakeresi

(1) Hüküm, gizli müzakere edilerek hazırlanır ve alenen tefhim olunur.

(2) Hükmü, yargılamanın sona erdiğinin bildirildiği duruşmada hazır bulunan hâkim veya hâkimler verir. Bu şekilde hüküm verebilecek hâkimlerin tamamı hazır bulunmadıkça hüküm hakkında görüşme yapılamaz.

(3) Hükmün müzakeresi sırasında, yargılamanın sona erdiğinin bildirildiği duruşmada hazır bulunan hâkim bulunmuyorsa, gerekli görüldüğü takdirde tarafların sözlü açıklamaları tekrar dinlendikten sonra müzakere edilir ve hüküm verilir.
