Article 298: Writing of the judgment

Part Five: Judgment and Acts of the Parties Terminating the Action › Chapter One: Judgment

(1) The judgment shall be written by the judge who rendered it or, in panel courts, by the presiding judge or by a member chosen by the presiding judge from among the judges who participated in the judgment.

(2) The reasoned decision may not contradict the operative part of the judgment pronounced.

(3) The dissenting opinion shall also be included in the judgment together with its reasons.

(4) The judgment shall be signed by the judge or judges who rendered it and by the court clerk.

MADDE 298 · Hükmün yazılması

(1) Hüküm, hükmü veren hâkim, toplu mahkemelerde başkan veya hükme katılmış olan hâkimlerden başkanın seçeceği bir üye tarafından yazılır.

(2) Gerekçeli karar, tefhim edilen hüküm sonucuna aykırı olamaz.

(3) Hükümde gerekçesi ile birlikte karşı oya da yer verilir.

(4) Hüküm, hükmü veren hâkim veya hâkimler ile zabıt kâtibi tarafından imzalanır.
