Additional Article 2

Chapter Nine: Special Provisions on Mass Housing Developments

Added: 13/4/1983, Law No. 2814, Art. 15

Doormen, boiler operators, gardeners and watchmen, as well as managers appointed from outside, whose contracts have been terminated for any reason or have expired, by the board of condominium owners or by the manager authorised by that board, shall be obliged to vacate within fifteen days any premises allocated to them by reason of these duties. Premises not vacated within this period shall, upon the application of the manager or of any of the condominium owners, be vacated by the law enforcement authorities within one week by decision of the local administrative authorities, without the need for any further service of documents. An application to administrative and judicial bodies shall not stay the execution of these decisions. The rights of the persons concerned arising from the law and the contract are reserved.

Kat malikleri kurulunca veya bu kurulca yetki verilen yönetici tarafından sözleşmeleri herhangi bir nedenle feshedilen veya sona eren, kapıcı, kaloriferci, bahçıvan ve bekçiler ile dışarıdan atanan yöneticiler kendilerine bu görevleri dolayısıyla bir yer tahsis edilmiş ise, bu yerleri onbeş gün içerisinde boşaltmak zorundadırlar. Bu süre içinde boşaltılmayan yerler yöneticinin veya kat maliklerinden herhangi birinin başvurusu üzerine başkaca tebligata lüzum kalmadan mahalli mülki amirlerin kararı ile bir hafta içinde zabıtaca boşalttırılır. İdare ve yargı organlarına yapılacak başvuru, bu kararların yerine getirilmesini durdurmaz. İlgililerin kanun ve sözleşmeden doğan hakları saklıdır.
