Common expenses relating to common areas and facilities allocated to the common use and enjoyment of the condominium owners of a particular building or of only some of the buildings within the scope of the mass housing development shall be borne by the condominium owners in those buildings, and common expenses relating to facilities and areas allocated to the common use and enjoyment of all independent sections shall be borne by all condominium owners.
Decisions of the block board of condominium owners, the mass housing board of representatives and the interim management board shall be deemed among the documents specified in the first paragraph of Article 68 of Enforcement and Bankruptcy Law No. 2004.
Condominium owners may not avoid paying their share of the mass housing common expenses and the advances to be collected by waiving their right to use the common buildings, areas and facilities within the scope of the mass housing development, or by asserting that these are located on another parcel or in public areas, or that there is no need or requirement to benefit from them due to the situation of their independent sections or of themselves.

MADDE 72 · Ortak giderlere katılma

Toplu yapı kapsamındaki belli bir yapıya veya yapıların sadece birkaçındaki kat maliklerinin ortak kullanım ve yararlanmasına tahsis edilmiş ortak yer ve tesislere ilişkin ortak giderler, o yapılardaki kat malikleri tarafından, bütün bağımsız bölümlerin ortak kullanım ve yararlanmasına tahsis edilmiş tesis ve yerlere ilişkin ortak giderler ise bütün kat malikleri tarafından karşılanır.
Blok kat malikleri, toplu yapı temsilcileri ve geçici yönetim kurulu kararları, 2004 sayılı İcra ve İflas Kanununun 68 inci maddesinin birinci fıkrasında belirtilen belgelerden sayılır.
Kat malikleri, toplu yapı kapsamındaki ortak yapı, yer ve tesisler üzerindeki kullanma hakkından vazgeçmek veya bunların başka bir parselde veya kamuya ait alanlarda bulunduğunu veya bağımsız bölümlerinin veya kendilerinin durumu dolayısıyla bunlardan faydalanmaya lüzum ve ihtiyaç bulunmadığını ileri sürmek suretiyle toplu yapı ortak gider payını ve toplanacak avansı ödemekten kaçınamazlar.
