Article 36: Cancellation of a title deed entry obtained after expropriation

Part Eight: Miscellaneous Provisions

Where, after the necessary procedures under the expropriation laws have been completed and the transfer to the administration of those registered in the land register and the registration of those not registered in the land register have been effected, a title deed is again established, for any reason whatsoever, in the name of natural or legal persons for the expropriated place, the judge shall, upon the request of the administration, examine the matter on the documents and, if deemed necessary, on site, and render a decision on the cancellation of the subsequent entry.

These procedures are not subject to fees (harç) or duties.

MADDE 36 · Kamulaştırmadan sonra alınan tapu kaydının iptali

Kamulaştırma kanunları uyarınca gerekli işlemler tamamlanıp tapuda kayıtlı olanların idare adına intikallerinin yapılmasından, tapuda kayıtlı olmayanların tescillerinin sağlanmasından sonra, kamulaştırılan yer için herhangi bir nedenle gerçek ve tüzelkişiler adına yeniden tapu tesis edildiği takdirde, idarenin isteği üzerine hakim, evrak üzerinde ve lüzum gördüğü takdirde mahallinde inceleme yaparak sonraki kaydın iptali hakkında bir karar verir.
