Article 3

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

In this Law, the term public receivable means:

receivables falling within the scope of Articles 1 and 2,

The term public debtor or debtor means:

natural and legal persons obliged to pay a public receivable and their legal representatives or heirs, as well as taxpayers, persons with tax liability, guarantors and representatives of foreign persons and entities,

The term creditor public administration means:

the State, the special provincial administrations and the municipalities,

The term collection office means:

the office, service, officer or officers of the creditor public administration charged with applying this Law,

The term property, where used alone, means:

movable and immovable property ("including ships"), and rights and receivables of every kind,

The term fines means:

judicial and administrative fines,

public receivables that cannot be collected for reasons such as the absence of any attachable assets of the public debtor as a result of the asset investigation conducted under the provisions of this Law, or the sale proceeds failing to cover the public receivable even though the attached assets have been sold and converted into money,

Added: 4/6/2008, Law No. 5766, Art. 1 The term public receivable found to be uncollectible means:

public receivables which, at any stage of the enforcement proceedings conducted by the collection offices, prove to be uncollectible from the public debtor for reasons such as it becoming apparent that the values assessed under the provisions of this Law for the attached assets of the public debtor will not cover the public receivable, or that the public receivable claimed from a public debtor against whom a bankruptcy decision has been rendered cannot be collected from the bankruptcy estate,

The term enforcement costs means:

costs of every kind incurred in the course of operations arising from compulsory enforcement, such as the costs of use of force, announcement, attachment, transport and safekeeping.

MADDE 3

Bu kanundaki amme alacağı terimi:

1 inci ve 2 nci maddeler şümulüne giren alacakları,

Amme borçlusu veya borçlu terimi:

Amme alacağını ödemek mecburiyetinde olan hakiki ve hükmi şahısları ve bunların kanuni temsilci veya mirasçılarını ve vergi mükelleflerini, vergi sorumlusunu, kefili ve yabancı şahıs ve kurumlar temsilcilerini,

Alacaklı amme idaresi terimi:

Devleti, vilayet hususi idarelerini ve belediyeleri,

Tahsil dairesi terimi:

Alacaklı amme idaresinin bu kanunu tatbik etmekle vazifeli dairesini, servisini, memur veya memurlarını,

Yalnızca mal olarak geçen terim:

Menkul, gayrimenkul "gemiler dahil" mallarla, her çeşit hak ve alacakları,

Para cezaları terimi:

Adli ve idari para cezalarını,

(Ek: 4/6/2008-5766/1 md.) Tahsil edilemeyen amme alacağı terimi:

Amme borçlusunun bu Kanun hükümlerine göre yapılan mal varlığı araştırması sonucunda haczi kabil herhangi bir mal varlığının bulunmaması, haczedilen mal varlığının satılarak paraya çevrilmesine rağmen satış bedelinin amme alacağını karşılamaması gibi nedenlerle tahsil edilemeyen amme alacaklarını,

(Ek: 4/6/2008-5766/1 md.) Tahsil edilemeyeceği anlaşılan amme alacağı terimi:

Amme borçlusunun haczedilen mal varlığına bu Kanun hükümlerine göre biçilen değerlerin amme alacağını karşılayamayacağının veya hakkında iflas kararı verilen amme borçlusundan aranılan amme alacağının iflas masasından tahsil edilemeyeceğinin anlaşılması gibi nedenlerle tahsil dairelerince yürütülen takip muamelelerinin herhangi bir aşamasında amme borçlusundan tahsil edilemeyeceği ortaya çıkan amme alacaklarını,

Takibat giderleri terimi:

Cebri icradan mütevellit muameleler sırasında yapılan zor kullanma, ilan, haciz, nakil ve muhafaza giderleri gibi her türlü giderleri, ifade eder.
