Article 198: Condition for restoration to the previous state in a hearing held without the accused being present

Book Three: Prosecution Stage › Part One: Conduct of the Public Action › Chapter Two: Hearing

(1) If the hearing is held without the accused being present, the accused may, within one week from the date on which the decisions and acts of the court are served on him or her, on legal grounds, request restoration to the previous state (eski hâle getirme) in respect of those decisions and acts of the court in order to remedy the consequences arising from the expiry of the time limit.

(2) However, if the accused has been exempted from the hearing upon his or her own request or has exercised the authority to be represented through his or her defence counsel, he or she may no longer request restoration to the previous state.

MADDE 198 · Sanık hazır bulunmaksızın yapılan duruşmada eski hâle getirme koşulu

(1) Duruşma, sanık hazır bulunmaksızın yapılırsa, mahkemenin karar ve işlemlerinin kendisine tebliği tarihinden itibaren bir hafta içinde, sürenin geçmesinden doğan sonuçları gidermek için sanık, kanunî nedenlere dayanarak, mahkemenin o karar ve işlemleri hakkında eski hâle getirme isteminde bulunabilir.

(2) Ancak, sanık kendi istemi üzerine duruşmadan bağışık tutulmuş veya müdafii aracılığıyla temsil edilmek yetkisini kullanmış olursa artık eski hâle getirme isteminde bulunamaz.
