Article 210: Documents that shall not be read out at the hearing

Book Three: Prosecution Stage › Part One: Conduct of the Public Action › Chapter Four: Presentation and Discussion of Evidence

(1) If the evidence of the fact consists solely of the statements of a witness, that witness shall in all cases be heard at the hearing. The reading of a record drawn up during a previous hearing or of a written statement may not replace the hearing.

(2) Where a person who may refuse to testify refuses to testify at the hearing, the record of his or her previous statement may not be read out.

MADDE 210 · Duruşmada okunmayacak belgeler

(1) Olayın delili, bir tanığın açıklamalarından ibaret ise, bu tanık duruşmada mutlaka dinlenir. Daha önce yapılan dinleme sırasında düzenlenmiş tutanağın veya yazılı bir açıklamanın okunması dinleme yerine geçemez.

(2) Tanıklıktan çekinebilecek olan kişi, duruşmada tanıklıktan çekindiğinde, önceki ifadesine ilişkin tutanak okunamaz.
