Article 595: a. Right to demand security and release from the debt

Part Two: Special Obligational Relationships › Chapter Fifteen: Contract of Suretyship

The surety may demand from the principal debtor the provision of security and, where the debt has become due, release from the debt in the following cases:

1. If the principal debtor has acted contrary to the obligations he assumed towards the surety, in particular the promise to release him from the debt within a certain period.

2. If the principal debtor is in default or if enforcement proceedings have become considerably more difficult because he has moved his domicile to another country.

3. If, as a result of the deterioration of the principal debtor's financial situation, the loss in value of the securities or the fault of the debtor, the risk existing for the surety has increased considerably compared with the date on which the suretyship was given.

MADDE 595 · a. Güvence verilmesini ve borçtan kurtarılmasını isteme hakkı

Kefil, aşağıdaki durumlarda asıl borçludan güvence verilmesini ve borç muaccel olmuşsa, borçtan kurtarılmasını isteyebilir:

1. Asıl borçlu, kefile karşı üstlendiği yükümlülüklere, özellikle belli bir süre içinde kendisini borçtan kurtarma vaadine aykırı davranmışsa.

2. Asıl borçlu temerrüde düşmüşse veya yerleşim yerini diğer bir ülkeye nakletmesi yüzünden takibat önemli ölçüde güçleşmişse.

3. Asıl borçlunun mali durumunun kötüleşmesi, güvencelerin değer kaybetmesi veya borçlunun kusuru sonucunda kefil için mevcut tehlike, kefaletin yapıldığı tarihe göre önemli ölçüde artmışsa.
