Article 85: 2. Indivisible obligation

Chapter Two: Effects of Obligations › Division One: Performance of Obligations A. In general

Where an indivisible obligation has more than one creditor, each of the creditors may demand performance of the obligation to all of the creditors. The debtor shall be obliged to perform to all of the creditors together.

Where an indivisible obligation has more than one debtor, each of the debtors shall be obliged to perform the entire obligation.

Unless otherwise inferred from the circumstances, the debtor who has performed shall be subrogated to the creditor and may claim from the other debtors in proportion to their shares.

MADDE 85 · 2. Bölünemeyen borç

Bölünemeyen bir borcun birden çok alacaklısı varsa, alacaklılardan her biri, borcun alacaklıların tamamına ifasını isteyebilir. Borçlu, edimini alacaklıların hepsine birden ifa etmek zorundadır.

Bölünemeyen borcun birden çok borçlusu varsa, borçlulardan her biri borcun tamamını ifa etmekle yükümlüdür.

Durumun gereğinden aksi anlaşılmadıkça, ifada bulunan borçlu, alacaklıya halef olur ve diğer borçlulardan payları oranında alacağını isteyebilir.
