Article 76: Regulations

Chapter Four: Organisation of Work

The procedures ensuring that, in work and workplaces where, by their nature, it is not possible to apply daily and weekly working times in the manner provided for in Article 63, working times are applied without exceeding the statutory daily working time and with a balancing period of up to a maximum of six months, shall be governed by regulations to be prepared by the Ministry of Labour and Social Security.

In work which, owing to its nature, is operated continuously by employing shifts of employees one after another without stopping, or which is carried out with rotating shifts of employees, the special procedures and principles relating to working times, weekly rest days, night work and compulsory rest breaks during work shall be governed by regulations to be prepared by the Ministry of Labour and Social Security.

MADDE 76 · Yönetmelikler

Nitelikleri gereği günlük ve haftalık çalışma sürelerinin 63 üncü maddede öngörüldüğü şekilde uygulanması mümkün olmayan iş ve işyerlerinde çalışma sürelerinin günlük yasal çalışma süresini aşmayacak şekilde ve en çok altı aya kadar denkleştirme süresi tanınarak uygulanmasını sağlayacak usuller Çalışma ve Sosyal Güvenlik Bakanlığınca hazırlanacak yönetmeliklerle düzenlenir.

Nitelikleri dolayısıyla devamlı çalıştıkları için durmaksızın birbiri ardına işçi postaları çalıştırılarak işletilen yahut nöbetleşe işçi postaları ile yapılan işlerde, çalışma sürelerine, hafta tatillerine ve gece çalışmalarına ve çalışma ortasındaki zorunlu dinlenmelere dair özel usul ve esaslar Çalışma ve Sosyal Güvenlik Bakanlığınca hazırlanacak yönetmeliklerle düzenlenir.
