(1) In offences committed jointly, only the accomplice who voluntarily abandons shall benefit from the provisions on voluntary abandonment.
(2) Where the offence:
a) Has not been committed for a reason other than the efforts made by the person who voluntarily abandons,
b) Has been committed despite all the efforts of the person who voluntarily abandons,
the provisions on voluntary abandonment shall also apply.

MADDE 41 · İştirak hâlinde işlenen suçlarda gönüllü vazgeçme
(1) İştirak halinde işlenen suçlarda, sadece gönüllü vazgeçen suç ortağı, gönüllü vazgeçme hükümlerinden yararlanır.
(2) Suçun;
a) Gönüllü vazgeçenin gösterdiği gayreti dışında başka bir sebeple işlenmemiş olması,
b) Gönüllü vazgeçenin bütün gayretine rağmen işlenmiş olması,
Hallerinde de gönüllü vazgeçme hükümleri uygulanır.
