Article 36: Voluntary abandonment

Part Two: Principles of Criminal Responsibility › Chapter Three: Attempt to Commit an Offence

(1) If the offender voluntarily abandons the acts of execution of the offence, or through his own efforts prevents the completion of the offence or the occurrence of the result, he shall not be punished for attempt; however, where the completed part in itself constitutes an offence, he shall be punished only with the penalty for that offence.

MADDE 36 · Gönüllü vazgeçme

(1) Fail, suçun icra hareketlerinden gönüllü vazgeçer veya kendi çabalarıyla suçun tamamlanmasını veya neticenin gerçekleşmesini önlerse, teşebbüsten dolayı cezalandırılmaz; fakat tamam olan kısım esasen bir suç oluşturduğu takdirde, sadece o suça ait ceza ile cezalandırılır.
