Article 24: Provision of law and order of a superior

Part Two: Principles of Criminal Responsibility › Chapter Two: Grounds Excluding or Reducing Criminal Responsibility

(1) No penalty shall be imposed on a person who executes a provision of law.

(2) A person who carries out an order issued by a competent authority, the execution of which is mandatory as a requirement of duty, shall not be responsible.

(3) An order the subject of which constitutes an offence shall in no case be carried out. Otherwise, the person carrying it out and the person giving the order shall be responsible.

(4) In cases where review of the lawfulness of the order is prevented by law, the person giving the order shall be responsible for its execution.

MADDE 24 · Kanunun hükmü ve amirin emri

(1) Kanunun hükmünü yerine getiren kimseye ceza verilmez.

(2) Yetkili bir merciden verilip, yerine getirilmesi görev gereği zorunlu olan bir emri uygulayan sorumlu olmaz.

(3) Konusu suç teşkil eden emir hiçbir surette yerine getirilemez. Aksi takdirde yerine getiren ile emri veren sorumlu olur.

(4) Emrin, hukuka uygunluğunun denetlenmesinin kanun tarafından engellendiği hallerde, yerine getirilmesinden emri veren sorumlu olur.
