Article 28: Force and violence, intimidation and threat

Part Two: Principles of Criminal Responsibility › Chapter Two: Grounds Excluding or Reducing Criminal Responsibility

(1) No penalty shall be imposed on a person who commits an offence as a result of force and violence which he or she cannot resist or escape, or as a result of certain and grave intimidation or threat. In such cases, the person using the force and violence, intimidation and threat shall be deemed the offender.

MADDE 28 · Cebir ve şiddet, korkutma ve tehdit

(1) Karşı koyamayacağı veya kurtulamayacağı cebir ve şiddet veya muhakkak ve ağır bir korkutma veya tehdit sonucu suç işleyen kimseye ceza verilmez. Bu gibi hallerde cebir ve şiddet, korkutma ve tehdidi kullanan kişi suçun faili sayılır.
