Article 11

Chapter One: General Principles

1. Before filing an administrative action, the persons concerned may, within the time limit for filing an administrative action, request the superior authority or, where there is no superior authority, the authority which performed the act, to revoke, withdraw or amend the administrative act or to perform a new act. Such application shall suspend the time limit for filing an administrative action that has begun to run.

2. If no reply is given within thirty days, the request shall be deemed to have been rejected.

3. Where the request is rejected or deemed to have been rejected, the time limit for filing an action shall resume running, and the period elapsed up to the date of application shall also be taken into account.

MADDE 11

1. İlgililer tarafından idari dava açılmadan önce, idari işlemin kaldırılması, geri alınması, değiştirilmesi veya yeni bir işlem yapılması üst makamdan, üst makam yoksa işlemi yapmış olan makamdan, idari dava açma süresi içinde istenebilir. Bu başvurma, işlemeye başlamış olan idari dava açma süresini durdurur.

2. Otuz gün içinde bir cevap verilmezse istek reddedilmiş sayılır.

3. İsteğin reddedilmesi veya reddedilmiş sayılması halinde dava açma süresi yeniden işlemeye başlar ve başvurma tarihine kadar geçmiş süre de hesaba katılır.
