1. Amended: 5/4/1990, Law No. 3622, Art. 2 Where actions whose resolution falls within the jurisdiction of the Council of State or of the administrative and tax courts have been filed before the ordinary (…) judicial authorities and are dismissed for lack of jurisdiction, an action may be filed before the competent court within thirty days from the day following the date on which the decisions on this matter become final. The date of application to the judicial authority lacking jurisdiction shall be accepted as the date of application to the Council of State or to the administrative and tax courts.
2. In actions filed before the ordinary (…) judicial authorities and dismissed for lack of jurisdiction, even if the thirty-day time limit set out in paragraph 1 has elapsed after the decision on lack of jurisdiction became final, an administrative action may be filed within the time limit prescribed for filing an administrative action, provided that such time limit has not yet expired.

1. (Değişik: 5/4/1990-3622/2 md.) Çözümlenmesi Danıştayın, idare ve vergi mahkemelerinin görevlerine girdiği halde, adli (…) yargı yerlerine açılmış bulunan davaların görev noktasından reddi halinde, bu husustaki kararların kesinleşmesini izleyen günden itibaren otuz gün içinde görevli mahkemede dava açılabilir. Görevsiz yargı merciine başvurma tarihi, Danıştaya, idare ve vergi mahkemelerine başvurma tarihi olarak kabul edilir.
2. Adli (…)6 yargı yerlerine açılan ve görevsizlik sebebiyle reddedilen davalarda, görevsizlik kararının kesinleşmesinden sonra birinci fıkrada yazılı otuz günlük süre geçirilmiş olsa dahi, idari dava açılması için öngörülen süre henüz dolmamış ise bu süre içinde idari dava açılabilir.
