Article 16

Chapter One: General Principles

1. A copy each of the petitions and their annexes shall be served on the defendant, and the defence submitted by the defendant shall be served on the claimant.

2. The claimant's second petition shall be served on the defendant, and the second defence submitted by the defendant shall be served on the claimant. The claimant may not reply thereto. However, if it becomes apparent during the hearing of the action that the defendant's second defence contains matters requiring a reply by the claimant, the claimant shall be granted a time limit to reply.

3. The parties may reply to the documents served on them within thirty days from the date of service. This time limit may be extended, only where there are justified reasons and upon the request of one of the parties, by decision of the competent court, once only and for a period not exceeding thirty days. Requests for extension made after the expiry of the time limit shall not be accepted.

4. The parties may not assert any right on the basis of defences or second petitions submitted after the expiry of the time limit. Added sentence: 11/4/2013, Law No. 6459, Art. 4 However, in full remedy actions, the amount specified in the petition may be increased once only, until the final decision is rendered, upon payment of the fee, irrespective of time limits or other procedural rules, and the petition concerning the increase of the amount shall be served on the opposing party for a reply within thirty days.

5. Amended: 10/6/1994, Law No. 4001, Art. 8 The originals or certified copies of the administrative files relating to the actions shall be sent, together with the defence of the administration, to the Council of State or to the presidency of the relevant court.

6. Added: 2/7/2012, Law No. 6352, Art. 54 In actions heard by the Council of State as a court of first instance, the written opinion of the prosecutor on the merits shall be served on the parties. The parties may submit their views in writing within ten days from service.

MADDE 16

1. Dava dilekçelerinin ve eklerinin birer örneği davalıya, davalının vereceği savunma davacıya tebliğ olunur.

2. Davacının ikinci dilekçesi davalıya, davalının vereceği ikinci savunma da davacıya tebliğ edilir. Buna karşı davacı cevap veremez. Ancak, davalının ikinci savunmasında, davacının cevaplandırmasını gerektiren hususlar bulunduğu, davanın görülmesi sırasında anlaşılırsa, davacıya cevap vermesi için bir süre verilir.

3. Taraflar, yapılacak tebliğlere karşı, tebliğ tarihinden itibaren otuz gün içinde cevap verebilirler. Bu süre, ancak haklı sebeplerin bulunması halinde, taraflardan birinin isteği üzerine görevli mahkeme kararı ile otuz günü geçmemek ve bir defaya mahsus olmak üzere uzatılabilir. Sürenin geçmesinden sonra yapılan uzatma talepleri kabul edilmez.

4. Taraflar, sürenin geçmesinden sonra verecekleri savunmalara veya ikinci dilekçelere dayanarak hak iddia edemezler. (Ek cümle: 11/4/2013-6459/4 md.) Ancak, tam yargı davalarında dava dilekçesinde belirtilen miktar, süre veya diğer usul kuralları gözetilmeksizin nihai karar verilinceye kadar, harcı ödenmek suretiyle bir defaya mahsus olmak üzere artırılabilir ve miktarın artırılmasına ilişkin dilekçe otuz gün içinde cevap verilmek üzere karşı tarafa tebliğ edilir.

5. (Değişik: 10/6/1994-4001/8 md.) Davalara ilişkin işlem dosyalarının aslı veya onaylı örneği idarenin savunması ile birlikte, Danıştay veya ilgili mahkeme başkanlığına gönderilir.

6. (Ek: 2/7/2012-6352/54 md.) Danıştayda ilk derece mahkemesi sıfatıyla görülen davalarda savcının esas hakkındaki yazılı düşüncesi taraflara tebliğ edilir. Taraflar, tebliğden itibaren on gün içinde görüşlerini yazılı olarak bildirebilirler.
