Article 12

Chapter One: General Principles

The persons concerned may, on account of an administrative act infringing their rights, file directly before the Council of State and the administrative and tax courts a full remedy action, or an action for annulment and a full remedy action together; alternatively, they may first file an action for annulment and, upon that action being decided, file a full remedy action within the time limit for filing an action running from the service of the decision on this matter or, where legal remedies have been pursued, of the decision rendered thereon, or, in respect of damages arising from the enforcement of an act, from the date of enforcement. In this case as well, the right of the persons concerned to apply to the administration under Article 11 is reserved.

İlgililer haklarını ihlal eden bir idari işlem dolayısıyla Danıştaya ve idare ve vergi mahkemelerine doğrudan doğruya tam yargı davası veya iptal ve tam yargı davalarını birlikte açabilecekleri gibi ilk önce iptal davası açarak bu davanın karara bağlanması üzerine, bu husustaki kararın veya kanun yollarına başvurulması halinde verilecek kararın tebliği veya bir işlemin icrası sebebiyle doğan zararlardan dolayı icra tarihinden itibaren dava süresi içinde tam yargı davası açabilirler. Bu halde de ilgililerin 11 nci madde uyarınca idareye başvurma hakları saklıdır.
