Article 55

Chapter One: General Principles

1. If the matter to which the request relates has come within the jurisdiction of another chamber or court, the decision shall be rendered by that chamber or court.

2. Requests shall be examined after the defence of the opposing party has been obtained, and, if the grounds set out in the law exist, the action shall be heard anew and a decision rendered.

3. Amended: 10/6/1994, Law No. 4001, Art. 25 If requests for retrial (…) are not based on the grounds set out in the law, a decision dismissing the request shall be rendered.

4. The holding of a hearing on requests for retrial (…) shall be subject to the decision of the competent chamber or court.

5. Without prejudice to the provisions of this Article and of Article 53, the other provisions of this Law shall apply in retrial (…).

MADDE 55

1. İsteğin ilişkin olduğu konu, diğer bir daire veya mahkemenin görevine girmiş ise karar bu daire veya mahkemece verilir.

2. Karşı tarafın savunması alındıktan sonra istekler incelenir ve kanunda yazılı sebepler varsa davaya yeniden bakılarak karar verilir.

3. (Değişik: 10/6/1994-4001/25 md.) Yargılamanın yenilenmesi (…)49 istemleri, kanunda yazılı sebeplere dayanmıyor ise, istemin reddine karar verilir.

4. Yargılamanın yenilenmesi (…)49 istemlerinde duruşma yapılması, görevli daire veya mahkemenin kararına bağlıdır.

5. Bu madde ile 53 üncü madde hükümleri saklı kalmak kaydıyla, yargılamanın yenilenmesinde (…)49 bu Kanunun diğer hükümleri uygulanır.
