For the determination of the status of places where land titling or cadastre has not been carried out, the administration shall apply to the local chief administrative officer and request the selection of four experts, two principal and two substitute, at the place where the expropriation is to be carried out. Upon this request of the administration, the chief administrative officer shall ensure, within eight days, that the experts are selected, that they are sworn in before the civil court of peace and that their names are notified to the administration that will carry out the expropriation.
During the determination, the mukhtar (village or neighbourhood head) or his or her deputy, two members of the council of elders and two experts shall perform their duties together.
The mukhtar or his or her deputy, the members of the council of elders and the experts who serve in this determination shall be paid for the days on which they work in accordance with Article 29.

MADDE 9 · Kadastro görmemiş yerlerde tespit işlemi
İdare, tapulama veya kadastrosu yapılmamış yerlerin durumunun tespiti için mahallin mülki amirine müracaatla, kamulaştırma yapılacak yerde iki asıl ve iki yedek olmak üzere dört bilirkişinin seçilmesini ister. Mülki amir idarenin bu istemi üzerine sekiz gün içerisinde bilirkişilerin seçilmesini ve sulh hukuk mahkemesinde yeminlerinin yaptırılarak isimlerinin kamulaştırmayı yapacak idareye bildirilmesini sağlar.
Tespit sırasında muhtar veya vekili, ihtiyar kurulundan iki üye ve iki bilirkişi birlikte görev yaparlar.
Bu tespitte görev yapan muhtar veya vekili, ihtiyar kurulu üyeleri ile bilirkişilere çalıştıkları günler için 29 uncu maddeye göre ödeme yapılır.
