Where the transfer by inheritance has not been effected in the land register within two years at the latest from the date of death, the land registry directorate may apply to the judiciary for the issuance of a certificate of inheritance. The land registry directorate shall update the land register records by registering them as joint ownership (elbirliği mülkiyeti) in accordance with the certificate of inheritance. Applications of the land registry directorate within the scope of this power shall be exempt from all kinds of expenses, taxes, duties and fees.

Ölüm tarihinden itibaren en geç iki yıl içinde tapu sicilinde miras intikalinin gerçekleşmemesi halinde tapu müdürlüğü, mirasçılık belgesi düzenlenmesi için yargıya başvurabilir. Tapu müdürlüğü mirasçılık belgesine göre tapu sicili kayıtlarını elbirliği mülkiyeti şeklinde tescil ederek güncelleştirir. Tapu müdürlüğünün bu yetki kapsamındaki başvuruları her türlü gider, vergi, resim veya harçtan muaftır.
