Recourse claims to be brought against negligent personnel in respect of payments made owing to the strict liability of the State in connection with land registry and cadastral transactions shall be subject to limitation upon the expiry of two years from the date of payment and, in any event, ten years from the date on which the transaction causing the damage was carried out. The provisions of Article 73 of the Turkish Code of Obligations No. 6098 dated 11/1/2011 shall be reserved for personnel whose liability is based on gross fault.

Tapu ve kadastro işlemleri ile ilgili olarak, Devletin kusursuz sorumluluğu sebebiyle yapılan ödemeler dolayısıyla, ihmali bulunan personel aleyhine başlatılacak rücu istemleri, ödeme tarihinden itibaren iki yıl, her hâlde zarara yol açan işlemin gerçekleştirildiği tarihten itibaren on yılın geçmesiyle zamanaşımına uğrar. Ağır kusura dayalı sorumluluğu bulunan personel için 11/1/2011 tarihli ve 6098 sayılı Türk Borçlar Kanununun 73 üncü maddesi hükümleri saklıdır.
