Article 46: Humanitarian residence permit

Part Two: Foreigners › Chapter Two: Residence

(1) In the following cases, a humanitarian residence permit may be granted, and such permits may be extended, by governorships with the approval of the Directorate General, without seeking the conditions for the granting of other residence permits and provided that it is limited to periods determined by the Ministry:

a) Where the best interests of the child are concerned

b) Where, despite a deportation decision or a ban on entry into Türkiye having been issued concerning them, foreigners cannot be made to exit Türkiye or their departure from Türkiye is not deemed reasonable or possible

c) Where no deportation decision is issued concerning the foreigner pursuant to Article 55

ç) Where judicial remedies are sought against the actions taken under Articles 53, 72 and 77

d) Throughout the proceedings for the return of the applicant to the first country of asylum or to a safe third country

e) Where foreigners who must be permitted to enter and stay in Türkiye due to urgent reasons, or for the protection of national interests and in terms of public order and public security, have no possibility of obtaining one of the other residence permits because of circumstances that prevent the granting of a residence permit

f) In extraordinary situations

(2) Foreigners who obtain a humanitarian residence permit shall be obliged to register with the address registration system within twenty working days at the latest from the date of issue of the permit.

MADDE 46 · İnsani ikamet izni

(1) Aşağıda belirtilen hâllerde, diğer ikamet izinlerinin verilmesindeki şartlar aranmadan, Bakanlıkça belirlenen sürelerle sınırlı olmak kaydıyla ve Genel Müdürlüğün onayı alınarak valiliklerce insani ikamet izni verilebilir ve bu izinler uzatılabilir:

a) Çocuğun yüksek yararı söz konusu olduğunda

b) Haklarında sınır dışı etme veya Türkiye’ye giriş yasağı kararı alındığı hâlde, yabancıların Türkiye’den çıkışları yaptırılamadığında ya da Türkiye’den ayrılmaları makul veya mümkün görülmediğinde

c) 55 inci madde uyarınca yabancı hakkında sınır dışı etme kararı alınmadığında

ç) 53 üncü, 72 nci ve 77 nci maddelere göre yapılan işlemlere karşı yargı yoluna başvurulduğunda

d) Başvuru sahibinin ilk iltica ülkesi veya güvenli üçüncü ülkeye geri gönderilmesi işlemlerinin devamı süresince

e) Acil nedenlerden dolayı veya ülke menfaatlerinin korunması ile kamu düzeni ve kamu güvenliği açısından Türkiye’ye girişine ve Türkiye’de kalmasına izin verilmesi gereken yabancıların, ikamet izni verilmesine engel teşkil eden durumları sebebiyle diğer ikamet izinlerinden birini alma imkânı bulunmadığında

f) Olağanüstü durumlarda

(2) İnsani ikamet izni alan yabancılar, iznin veriliş tarihinden itibaren en geç yirmi iş günü içinde adres kayıt sistemine kayıt yaptırmak zorundadır.
